THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 6 of The Philadelphia Code is hereby amended to read as follows.

TITLE 6. HEALTH CODE.

CHAPTER 6-300. FOOD.

* * *

§ 6-301. Food Establishments.

* * *

(6) Every food establishment shall be conducted, operated, and maintained in accordance with such additional requirements as the Board may by regulation prescribe to protect the health of the ultimate consumers of food handled in such establishment. Such regulations may include, but shall not be limited to, reasonable requirements as to:

(a) The building structure, maintenance, sanitation, lighting, ventilation and cleanliness of food establishments.

(b) The regular, customary, and reputable preparation, composition, service, display, storage, refrigeration, sale, and packaging of food therein.

(c) The adequate supply of food within sufficient facilities for its preparation, composition, service, display, storage, refrigeration, packaging, and sale.

(d) The use, occupancy, size, arrangement, and seating capacity of the serving area.

([c]e) The personal hygiene and food service practices of persons handling food therein.

([d]f) The construction, cleaning, cleanliness, bactericidal treatment and storage of equipment and utensils.

([e]g) The disposal of liquid and solid waste.

([f]h) The handling, storage and protection of food in transit to and from food establishments within the City.

([g]i) The water supply.

([h]j) The control of arthropods and rodents.

(k) The sale and purchase of liquor, wine, and malt or brewed beverages.

(l) The provision and maintenance of public bathrooms and any facilities required by the Americans with Disabilities Act of 1990.

CHAPTER 6-500. ADMINISTRATIVE PROVISIONS.

§ 6-503. Licenses and Permits.

(1) Issuance and Conditions.

(a) All applications for any license required by this Title shall be made to the Department of Licenses and Inspections.

(a.1) All applications for any license required by this Title shall include a provision requiring the applicant to attest that he or she has complied with all applicable permits, licenses, laws, and regulations.

(c) The Department of Licenses and Inspections shall not issue any license unless:

(.4) the person applying therefore and the establishment or food for which such license is sought complies in every respect with all applicable permits, licenses, laws, and regulations, including but not limited to this Title and the requirements and standards required by the Board, as certified by the Department; and

(d) All licenses shall:

* * *

(.4) be conditioned upon continued compliance with all applicable permits, licenses, laws, and regulations, including but not limited to this Title and the Regulations of the Board issued under it.

SECTION 2. This Ordinance shall be effective immediately.
