Title
Authorizing B1 Holdings, ("Owner") to install, own and maintain an open-air sidewalk café at 767 South 9th Street, Philadelphia, PA 19147 ("Property"), under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain an open-air sidewalk café at the Property ("Encroachments") as follows:

Encroachment Description:

A sidewalk café in two parts:
Part 1
Along the north curb line of Catharine Street from a point approximately thirteen feet (13'-0") east of the east curb line of South 9th Street to a point approximately fifty -six feet six inches (56'-6") farther east, encroaching into the north footway of Catharine Street approximately three feet six inches (3'-6") leaving five feet six inches (5'-6") of clear unobstructed footway. No tables shall be placed prior to 7:00 p.m.
Part 2
Along the east curb line of South 9th Street from a point approximately twenty one feet six inches (21'-6") north of the north curb line of Catharine Street to a point approximately five feet six inches (5'-6") farther north, encroaching into the east footway of South 9th Street approximately three feet six inches (3'-6") leaving six feet ten inches (6'-10") of clear unobstructed footway. No tables shall be placed prior to 7:00 p.m.

SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses & Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard tolerances of current engineering practice.
