Title
Authorizing Gaul & Co. Malt House, ("Owner") to install, own and maintain an open-air sidewalk café at 3133 Gaul Street, Philadelphia, PA 19134 ("Property"), under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain an open-air sidewalk cafe at the Property ("Encroachments") as follows:

Encroachment Description:

A sidewalk café in two parts:

Part 1

Along the south building line of 3133 Gaul Street from a point approximately twenty-four feet six inches (24'-6") east of the east curbline of Gaul Street to a point approximately forty-two feet (42'-0") farther east, encroaching into the north footway of Clementine Street two feet ten inches (2'-10") leaving five feet (5'-0") of clear unobstructed footway.

Part 2

Along the west building line of 3133 Gaul Street from a point approximately sixteen feet six inches (16'-6") north of the north curbline of Clementine Street to a point seven feet three inches (7'-3") farther north, encroaching into the east footway of Gaul Street four feet (4'-0") leaving eight feet (8'-0") of clear unobstructed footway.

SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses & Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments, boards, agencies or commissions. No such department, board, agency or commission shall be required to i...
