Authorizing The Bagel Place Shop LLC., ("Owner") to install, own and maintain an open air sidewalk café at 404 Queen Street, Philadelphia, PA 19147 ("Property"), under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Permission is hereby granted to Owner to install, own and maintain an open-air sidewalk cafe at the Property ("Encroachments") as follows:
Encroachment Description:
A sidewalk café in two parts:
Part 1
Along the east building line of 404 Queen Street from the south property line of 404 Queen Street to a point approximately twenty-six feet (26'-0") farther north, encroaching into the west footway of 4th Street approximately four feet two inches (4'-2") leaving a minimum of five feet (5'-0") of clear unobstructed footway.
Part 2
Along the south building line of 404 Queen Street from a point approximately nineteen feet (19'-0") west of the 404 Queen Street east property line to a point approximately seventeen feet (17'-0") farther west, encroaching into the south footway of Queen Street approximately four feet six inches (4'-6") leaving a minimum of five feet (5'-0") of clear unobstructed footway.
SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses & Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard tolerances of current engineering practice.
SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments, boards, agencies or commissions. No such department, board, agency or commission shall be required to iss...
