Proposing an amendment to the Philadelphia Home Rule Charter relating to the operating budget and providing for a mandatory fifty million dollar ($50,000,000) minimum annual appropriation to the Housing Trust Fund or any such successor financial facility or such successor financial facilities; and providing for the submission of the proposed amendment to the electors of Philadelphia.

WHEREAS, Philadelphia persists as the poorest big city in the nation. That poverty is concentrated in historically underserved communities with substandard schools, unemployment, drug use, crime, and the costs of housing rising much faster than incomes. Philadelphia is experiencing an “Affordable Housing Crisi”s, with gentrification causing a dramatic decline of affordable housing: it is increasingly difficult for poor Philadelphians to find places to live; and
WHEREAS, Under Section 6 of the First Class City Home Rule Act (53 P.S. §13106), an amendment to the Philadelphia Home Rule Charter may be proposed by a resolution of the Council of the City of Philadelphia adopted with the concurrence of two-thirds of its elected members; now, therefore, be it
RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That the following amendment to the Philadelphia Home Rule Charter is hereby proposed and shall be submitted to the electors of the City of Philadelphia on an election date designated by ordinance:

§ 2-300. The Annual Operating Budget Ordinance.

(4) In every annual operating budget ordinance:

(g) At least fifty million dollars ($50,000,000), or such greater amount as shall be determined by City Council, shall be appropriated to the Housing Trust Fund created by an Ordinance (Bill No. 050059) approved July 8, 2005, codified at Philadelphia Code TITLE 21- MISCELLANEOUS, CHAPTER 21-600 - HOUSING TRUST FUND, or to any such successor financial facility or such successor financial facilities performing the functions of a facility promoting affordable housing for sale or rental, provided that if more than one such financial facility exists at the same time, City Council shall allocate the appropriation required by this subsection to such successor financial facility or such successor financial facilities as it deems appropriate. Such appropriation of funds shall be in addition to the funds deposited into the Housing Trust Fund collected pursuant to Philadelphia Code Title 10 – REGULATION OF INDIVIDUAL CONDUCT AND ACTIVITY, CHAPTER 10-1000 – FEES, Section 10-1001 – Fees of Commissioner of Records.
