Authorizing Wander Inn, Inc., ("Owner") to install, own and maintain an open-air sidewalk café at 2500 South 3rd Street, Philadelphia, PA 19148 ("Property"), under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain an open-air sidewalk cafe at the Property ("Encroachments") as follows:

Encroachment Description:

A sidewalk café, located along the west property line of 2500 South 3rd Street and along the south property line of Porter Street, in three (3) parts:

Part 1:
From a point approximately eight feet (8'-0") south of the Porter Street south Right-of-Way line to a point approximately seven feet (7'-0") farther south and encroaching into the west footway of South 3rd Street approximately seven feet (7'-0") toward the east.

Part 2:
From a point approximately twelve feet (12'-0") west of the South 3rd Street west Right-of-Way line to a point approximately thirty feet (30'-0") farther west and encroaching into the south footway of Porter Street approximately seven feet (7'-0") toward the north.

Part 3:
From a point approximately fifty feet (50'-0") west of the South 3rd Street west Right-of-Way line to a point approximately seven feet (7'-0") farther west and encroaching into the south footway of Porter Street approximately seven feet (7'-0") toward the north.
A minimum seven feet six inches (7'-6") of clear passable sidewalk space is to remain after installation.

SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses & Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard toleran...
