Amending Chapter 10-500 of The Philadelphia Code, entitled “Property - Damaging, Defacing and Interfering With,” to prohibit camping on property without the owner’s permission, under certain conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Chapter 10-500 of The Philadelphia Code is hereby amended to read as follows:
CHAPTER 10-500. PROPERTY – DAMAGING, DEFACING AND INTERFERING WITH.
§ 10-501. Prohibited Conduct.

(3) No person shall camp on any private property without the written permission of the owner or manager of the property. To “camp” means to use any property for temporary or permanent outdoor living accommodation purposes, including: sleeping or making preparations to sleep; laying down or using for the purpose of sleeping any tent, tarpaulin, lean-to, sleeping bag, bedroll, mattress, blankets, or any form of cover or protection from the elements other than clothing; storing personal belongings; or making any fire.

§ 10-502. Penalties.
(1) The penalty for violation of § 10-501(1) or § 10-501[(3)](4) of this Chapter shall be a fine of not less than $100 nor more than $300 except that acts of graffiti shall be subject to a fine of $300. * * *
(2) The penalty for violation of subsection 10-501(2) of this Chapter shall be a fine of not less than fifty (50) dollars, nor more than three hundred (300) dollars.
(3) The penalty for violation of subsection 10-501(3) of this Chapter (relating to camping) shall be a fine of twenty dollars ($20).
