Amending Chapter 9-1100 of The Philadelphia Code, entitled “Fair Practices Ordinance: Protections Against Unlawful Discrimination,” by revising the definitions of gender identity and sexual orientation.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1.  The Philadelphia Code is hereby amended to read as follows:

 

TITLE 9.  REGULATION OF BUSINESSES, TRADES AND PROFESSIONS.

CHAPTER 9-1100.  FAIR PRACTICES ORDINANCE: PROTECTIONS AGAINST UNLAWFUL DISCRIMINATION.

§ 9-1102.  Definitions.

(k)                     Gender Identity.  [Self-perception, or perception by others, as male or female, and shall include an individual’s appearance, behavior, or physical characteristics, that may be in accord with, or opposed to, one’s physical anatomy, chromosomal sex, or sex assigned at birth; and shall include, but not be limited to, individuals who are undergoing or have completed sex reassignment.]  An individual’s internal sense of gender, or one’s gender as perceived by others, that may or may not align with one’s physical anatomy, chromosomal sex, or sex assigned at birth. Examples include, but are not limited to, man, woman, non-binary, genderfluid, and agender.

(aa)                     Sexual Orientation.  [Male or female homosexuality, heterosexuality and bisexuality, by preference, practice or as perceived by others.]  An individual’s romantic, physical, sexual, or emotional attraction to others, or a lack of attraction to others, by preference, practice, or as perceived by others.  Examples include, but are not limited to, heterosexual, bisexual, gay, lesbian, and pansexual.

SECTION 2.  This Ordinance shall be effective immediately.
