Authorizing Aspen Operations, LLC ("Owner") to install, own, and maintain an open-air sidewalk caf? at 741 North 23rd Street, Philadelphia, PA 19130 ("Property"), all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Permission is hereby granted to the Owner to install, own, and maintain an open-air sidewalk caf? at the Property ("Encroachment"), as follows:
Encroachment Description:
A sidewalk caf?, located along the east Right-of-Way line of North 23rd Street and along the north Right-of-Way line of Aspen Street, in two (2) parts:
Part 1:
From a point approximately six feet six inches (6'-6") north of the Aspen Street north Right-of-Way line to a point approximately nine feet eleven inches (9'-11") farther north and encroaching upon the east footway of North 23rd Street approximately six feet four inches (6'-4") toward the west.
Part 2:
From a point approximately twenty-five feet five inches (25'-5") east of the North 23rd Street east Right-of-Way line to a point approximately fifty-two feet (52'-0") farther east and encroaching upon the north footway of Aspen Street approximately five feet six inches (5'-6") toward the south.
A clear passable sidewalk space, with a minimum width of six feet (6'-0") on Aspen Street and five feet two inches (5'-2") on North 23rd Street, is to remain after installation.
The hours of operation for the sidewalk caf? shall be: Monday - Sunday: 11:00 a.m. - 9 p.m.
SECTION 2. The construction, use and maintenance of the Encroachment described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections, the Department of Streets, and the Art Commission, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering...
