THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Chapter 13-100 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 13-100. WATER, SEWER AND STORM WATER RATES

(4) Standards for Rates and Charges.

* * *

(e) Special rates and charges, to be designated as "charity water rates and charges", shall be established for public and private schools, institutions of purely public charity, and places used for actual religious worship.

(i) Upon determination by the Labor Standards Unit (as established by ? 17-107 ("Contractors: Labor-Management Relationships)) of a violation of the requirements of ? 17-107(12) ("Recipients of Financial Assistance") applicable to properties that benefit from financial assistance in connection with the receipt of charity water rates and charges, including the prevailing wage requirements and the bond posting conditions, the Unit may order as a remedy for such violation:

(.a) payment of appropriate back wages and benefits;

(.b) compliance with the relevant wage and benefit standards;

(.c) termination of the receipt of charity water rates and charges until compliance;

(.d) posting of a bond required under Subsection 17-107(12)(c)(.2);

(.e) such other remedy as may be appropriate in the circumstances.

(ii) Such determinations and orders shall be subject to appeal before the Board of Labor Standards pursuant to the standards and procedures set forth in Code Section 17-107 ("Contractors: Labor-Management Relations").
