Title

Amending Chapter 12-2900 of The Philadelphia Code (“Contractor Parking”) to revise  the requirements and limitations related to contractor parking permits, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1. Title 12 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 12-2900 CONTRACTOR PARKING

§ 12-2902. Contractor Parking Permit.

 

(1)  When a vehicle displaying a current and valid [contractor parking permit] Contractor Parking Permit is being used [for contractor service] in connection with contracting work, the driver may park without limitation as to time and without payment of any parking meter fees [on streets] at locations where parking otherwise is [limited as to time but] not prohibited, subject to the limitations and requirements of subsection (2) below. The Department may by regulation limit the locations where Contractor Parking Permits will be honored.

 

                      (2)   Limitations.  Upon the effective date of the ordinance authorizing this section:

 

                                           (a) Parking under a Contractor Parking Permit shall be limited to a maximum of nine hundred (900) hours for each six (6) month period the permit is valid, and subject to the registered owner of the vehicle maintaining registration under a system established by the Department or the Authority to record hours parked, which system must be utilized while parking in any location where special contractor parking is authorized. The Department may revise the maximum number of hours for which a Contractor Parking Permit is valid by regulation, but not before both July 1, 2025 and before conducting a study of the total usage of Contractor Parking Permits; and

 

                                           (b)                      Parking for periods of time beyond such total maximum amount of hours pursuant to a Contractor Parking Permit shall be subject to an additional charge of One Dollar ($1) for every hour exceeded beyond the maximum amount.

 

                                          (c) Each Contractor Parking Permit shall be issued or renewed for one particular vehicle, shall be valid for six (6) months, and may not be transferred to another vehicle.

 

(3)   Contractor Parking Permits shall be issued and renewed by the Authority. A person requesting issuance or renewal of a Contractor Parking Permit shall make written application to the Authority upon forms supplied by the Authority. The Authority shall approve the application if it determines that the Contractor Parking Permit is being requested for a contractor vehicle which is used for contractor service, and if it finds that there are not three (3) or more unpaid parking violation fines imposed for the vehicle, or any unpaid taxes or fees due the City of Philadelphia, unless the applicant has entered into a payment agreement with the Authority and/or the City for such unpaid fines, taxes or fees. [Upon approval of the application and payment of a fee of one hundred fifty ($150) dollars, the Authority shall issue or renew the Contractor Parking Permit.]

(6)                          Fees for Contractor Parking Permits are as follows:

 

                                          (a)                       Between the Effective Date of the ordinance authorizing this section and January 1, 2024: One Hundred Fifty Dollars ($150). 

 

(b)                                           Effective January 1, 2024, Three Hundred Dollars ($300). 

 

                                          (c)                       After July 1, 2024, the Department may revise the fee by regulation, provided that the fee shall not exceed Three Hundred Dollars ($300), multiplied by the CPI Multiplier. The CPI Multiplier shall be equal to the most recently published Consumer Price Index for all Urban Consumers (CPI-U) All Items Index, Philadelphia, Pennsylvania, as of the effective date of the proposed fee increase, divided by the most recently published CPI-U as of July 1, 2023. 

 

                     (7)                      Temporary Restriction on Certain Regulations. Notwithstanding the provisions of this Section 12-2902, the Department shall make no regulation before July 1, 2027 increasing the number of parking spaces designated as "Contractor Placard Not Valid This Block.”

SECTION 2. This Ordinance shall be effective the later of 180 days after it becomes law or 30 days after the effective date of regulations implementing a system to record hours parked under a Contractor Parking Permit.
