Title

Authorizing the installation, ownership, and maintenance of a Streetery in the Right-of-Way adjacent to 1631 Packer Avenue, currently the location of a restaurant known as Philadium, under certain terms and conditions.

 

Body

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1. Permission is hereby granted to Cerco Investments LLC (the “Owner”), to install, own, and maintain a Streetery in the parking lane portion of the Right-of-Way adjacent to 1631 Packer Avenue (the “Streetery”) as follows:

 

Property: 1631 Packer Avenue (the “Property”), the location of a restaurant known as Philadium.

 

Streetery Description:

 

A Streetery, occupying the parking lane of the cartway on 11th Street directly in front of the Property.

 

SECTION 2. The construction, use, and maintenance of the Streetery described and listed in Section 1 shall be in accordance with Section 9-215 of The Philadelphia Code and all appliable regulations, as well as all other applicable laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections, the Department of Streets, and the Art Commission.

 

SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate departments, boards, agencies or commissions, including a Streetery License. No such department, board, agency or commission shall be required to issue any such permit, license or approval solely because this Ordinance has been enacted, it being the express intent of this Ordinance not to supersede any other provision of law governing the issuance of such permits, licenses or approvals.

 

SECTION 4. Except for the authorized location of this Streetery, nothing in this ordinance shall act as a waiver of any requirement of Section 9-215 of the Code or the regulations adopted thereunder.  If the requirements of the Code or regulations prohibit placement or operation of a Streetery at this location, this authorization does not supersede such limitations. 

 

SECTION 5. The permission granted to Owner to install, own, and maintain the Streetery described in Section 1 shall expire without any further action by the City of Philadelphia if: (1) Owner has not obtained a Streetery License within one (1) year after this Ordinance becomes law; or (2) upon the sale or other conveyance of the business holding the Streetery License for the Property.
