THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
Section 1. Permission is hereby granted to the University of Pennsylvania ("Owner") to install, own, and maintain encroachments at 3317-33 Chestnut Street (the "Property"). as specified in the Encroachment Description below (collectively, the "Encroachments"), subject to all restrictions set forth in this ordinance.
Encroachment Description:
1. Tree Planters
Six (6) tree planters encroaching approximately two feet six inches (2'-6") towards the south along the north footway of Chestnut Street starting at a point approximately thirty-three feet eleven inches (33'-11") east of the east curb line of South 34th Street to a point approximately two hundred forty-one ten inches (241'-10") farther east, leaving a minimum of nine feet (9'-0") of clear unobstructed footway.
2. Removable Benches
Eleven (11) removable benches encroaching along the north footway of Chestnut Street starting thirty-three feet eleven inches (33'-11") east of the east curb line of South 34th Street to a point approximately two hundred forty-one ten inches (241'-10") farther east, leaving a minimum of nine feet (9'-0") of clear unobstructed footway.
A minimum six feet (6'-0") of clear passable sidewalk space meeting the Complete Streets requirements is to remain after installation of all encroachments.
Section 2. The construction, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections, the Department of Streets, and the Art Commission, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension l...
