THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to the owner of 4333 Spruce Street, currently 4323 SPRUCE LP (the "Owner"), to install, own, and maintain encroachments at 4333 Spruce Street, Philadelphia, PA 19104 (the "Property") as follows:

Encroachment Description (collectively as described below, the "Encroachments"):

A. Four (4) tables and fourteen (14) seats will be located adjacent to the building and will encroach a distance of approximately four feet (4'-0") towards the west, along the east footway of South 44th Street starting from a point twenty-three feet (23'-0") north of the Spruce Street north curbline to a point approximately forty-two feet and four inches (42'-4") farther north leaving a minimum six feet (6'-0") of clear unobstructed footway.

B. Five (5) tables and ten (10) seats will be located along the curbline and will encroach a distance of approximately three feet (3'-0") towards the east, along the east footway of South 44th Street starting from a point twenty-nine feet two inches (29'-2") north of the Spruce Street north curbline to a point approximately forty-seven feet four inches (47'-4") farther north leaving a minimum six feet (6'-0") of clear unobstructed footway.


SECTION 2. The construction, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections, the Department of Streets, and the Art Commission, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.
