THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to the owner of the property identified below, currently Drexel Property Associates II LLC, or the owner's designee (the "Owner"), to install, own, and maintain an open-air sidewalk caf? (the "Encroachment") at 4430 Pine Street, Philadelphia, PA 19104 (the "Property"), as follows, subject to all restrictions set forth in this ordinance:

Encroachment Description:

Property: 4430 Pine Street, Philadelphia, PA 19104 D/B/A Knockbox Caf?

A sidewalk caf? located as follows, with a minimum of six feet (6'-0") of clear passable sidewalk space to remain after installation of each part identified below:

A total of four (4) tables and eight (8) seats for a sidewalk caf? and one (1) waste receptable bin will be located along the east sidewalk of North 45th Street along the property line of 4430 Pine Street written in two parts:

Part 1: Sidewalk Caf?
Four (4) tables and eight (8) seats will be located adjacent to the building of 4430 Pine Street and will encroach a distance of approximately two feet three inches (2'-3") towards the west along the east footway of North 45th Street starting from a point approximately seventy-six feet (76'-0") south of the Pine Street south curb line to a point approximately thirty-two feet eight inches (32'-8") farther south leaving a minimum of eight feet two inches (8'-2") of clear unobstructed footway.

Part 2: Waste Receptacle Bins
One (1) proposed waste receptacle bin will be located adjacent to the building of 4430 Pine Street and will encroach a distance of approximately one foot three inches (1'-3") towards the west along the east footway of North 45th Street starting from a point approximately one hundred and sixteen feet one inch (116'-1") to a point approximately one ...
