Authorizing the Commissioner of Public Property, on behalf of the City of Philadelphia, to modify certain easements and enter into an easement agreement with Famell, LLC for a portion of the parcel or parcels of land in and about the area bounded by Noble Street, 12th Street, Callowhill Street, and 13th Street, more commonly known as 411-19 North 13th Street, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1. The Commissioner of Public Property, on behalf of the City of Philadelphia, is hereby authorized to modify certain easements and enter into an easement agreement with Famell, LLC for the City to obtain an easement in connection with a portion of the parcel or parcels of land in and about the area bounded by Noble Street, 12th Street, Callowhill Street, and 13th Street, more commonly known as 411-19 North 13th Street, and more particularly identified in Exhibit “A. The modified easement agreement must contain reasonable restrictions on the development of 411-19 N. 13TH Street and 410-24 N. 12th Street satisfactory to the City to limit the amount of shading on the Viaduct Rail Park consistent with the City’s Urban Design Guidelines for Redevelopment Adjacent to the Viaduct Rail Park.

 

SECTION 2. The City Solicitor is hereby authorized to review and to approve, prior to execution, all instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interests of the City.
