Amending Section 9-203 of The Philadelphia Code, entitled “Sidewalk Sales,” to revise and clarify certain provisions related to City parks and recreation facilities and make related technical changes, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1. Section 9-205 of The Philadelphia Code is hereby amended to read as follows:

§ 9-205. Sidewalk Sales.

(1)   Definitions. In this Section, the following definitions apply:

(c)   Sidewalk. All that area legally open to the public use as a pedestrian public way between the curb line and the legal building line of the abutting [property.] property or, in case of a park, playground, or recreation center, between the curb line and the boundary of the park, playground, or recreation center.

(2)   Exemptions. The provisions of this Section do not apply to:

(h)  Vending on the sidewalk on or adjacent to any City park, playground, or recreation center under the jurisdiction or management of the Department of Parks and Recreation, which is prohibited unless approved by a permit issued by the Department of Parks & Recreation.
