Amending Chapter 11-200 of The Philadelphia Code, entitled “Openings and Excavations in the Streets,” to impose additional penalties on violators of underground permitting requirements, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS
Section 1. Chapter 11-200 of The Philadelphia Code is amended to read as follows:

§ 11-203. Sewer and Water Pipe and Other Underground Service.

(11) No permit shall be issued to any person who has violated this Chapter until all charges, fines and penalties have been paid.

§ 11-204. Underground Wires.
* * *
(4) No permit shall be issued to any person who has violated this Chapter until all charges, fines and penalties have been paid. This paragraph shall apply to any contractor performing work arising out of an existing right-of-way agreement or franchise but shall not apply to any permittee whose compliance is directly required by and enforceable under such an agreement.
...[(4)] (5) Any person who has been permitted to lay underground wires shall relocate such wires upon the written request of the Department of Streets or any other City agency, when they will interfere with proposed construction.

§ 11-205. Penalties.
(1) The maximum penalty for violation of Sections 11-203 and 11-204 shall be four hundred fifty dollars ($450) for each offense. Each day the violation continues is a separate offense.
(2) All other violations of this Chapter shall be subject to penalties as set forth in Section 1-109.
