This Bill would transfer $6,776,000 in appropriation from Finance Department - Benefits to the Fire Department Class 100 appropriation, in violation of the FY05-FY09 Five-Year Financial Plan approved by PICA. The FY05 Operating Budget approved by City Council included budget increases for a few line items, primarily benefit costs and the Department of Human Services' needs-based budget, but the majority of City departments took significant budget reductions totaling $107.1 million. The budget of the Fire Department, which is the City's third-largest department, received a reduction, approved by City Council, for the first time in fifteen years as part of this total reduction of $107.1 million. In the fifteen years that the Fire Department has received steadily increasing appropriations while other departments have taken cuts, the number of structural fires has dropped dramatically. These bills amend the City's FY05 Capital Budget and FY05-FY10 Capital Program to add $7 million in the FY05 Capital Budget for the Recreational Facilities improvement allocation that is allocated to District City Council members. Between FY99, when District Council members first received an allocation of $1.2 million of Capital Budget funding each, and FY04, the City's Capital Budget declined by more than a third. The Capital Budget has been shrinking consistently since the mid-1990s because of the City's dwindling legal debt capacity under state law, as well as our increasing overall debt burden, yet City Council was not asked to share in that reduction until the FY05 Capital Budget. The intent of the legislation is to preserve City service contracts for local and/or domestic entities. In light of our current economic climate and rising unemployment rates, the intent of Bill 040184 is laudable. However, because Bill 040184 prohibits the City from entering into competitively bid and non-competitive service contracts with entities who perform any part of the work in any location outside the United States, and would require the City to include such a prohibition in every service contract, it exceeds Council's legislative authority.
