I am writing to note a legal issue raised by these bills. These bills purport to re-name two park facilities: Old Line Park, to be re-named "Jack Horgan and Memorial Field;" and Cobbs Creek Playground, to be renamed "Rufus O. Williams Memorial Playground." Both of these facilities were formerly under the jurisdiction of the Fairmount Park Commission and, by operation of the 2008 amendment to the Home Rule Charter consolidating the Park system with the Recreation Department, they are now under the jurisdiction of the Department of Parks and Recreation. The City Solicitor has advised that the power to name facilities subject to the former Fairmount Park's jurisdiction is vested solely in the Department of Parks and Recreation and that a City Council ordinance cannot control the Department's discretion regarding the naming of such facilities. Bill No. 120489 would impose a four dollar surcharge on all parking tickets. It would direct that half of the revenue from the surcharge be used by the City for maintenance of recreation facilities and half be directed to the Philadelphia Parking Authority for taxicab regulation. The City Solicitor has provided an opinion advising that although Council has clear authority to set the level of fines for parking violations, including the level of any "surcharges," state law and the City Charter govern the manner in which the revenue generated from those fines and surcharges is distributed. The opinion explains that there are two separate reasons - one based in state law, the other based in the Home Rule Charter - that the bill's provisions governing the distribution of revenue from the surcharge are invalid.
